Terms of Use

These Terms of Use (the "Terms") constitute a legal agreement governing your use of the RouteUp mobile application (the "App"). By downloading, installing, or using the App, you are deemed to have accepted these Terms. If you do not accept the Terms, do not use the App.

Parties and Scope
These Terms are entered into between RouteUp ("Developer", "we", "us") and the individual using the App ("User", "you"). The App provides electric vehicle (EV) route planning, charging station discovery, and range calculation services.
These Terms apply to all versions of the App (iOS and any web version) as well as any additional features offered in the future.

Account Creation and Security
2.1 Registration
You may need to create an account to use some features of the App. You are responsible for providing accurate, current, and complete information during registration. Providing false information may result in your account being suspended.
2.2 Account Security
You are solely responsible for the security of your account. Keep your password strong and do not share it with others. Notify us immediately if you suspect unauthorized access. We accept no liability for damages arising from unauthorized use of your account.
2.3 Account Transfer
You may not transfer or rent your account to another person. An account belongs to a single user only.

License and Usage Rights
3.1 License Granted
Subject to compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to download and use the App for personal, non-commercial purposes.
3.2 Restrictions
The following actions are strictly prohibited:
•Reverse engineering the App, attempting to access its source code, or creating derivative works
•Reselling, renting, or sublicensing the App for commercial purposes
•Attempting to disable the App's security measures
•Scraping data or engaging in abuse via automated tools (bots, scrapers, etc.)
•Activities that interfere with other users' ability to benefit from the App
•Sending bulk API requests that overload our services

Scope and Limitations of Service
4.1 Services Provided
•Electric vehicle range and charging planning
•Charging station location and availability information
•OSRM-based map routing
•Vehicle profile management (battery, charging type, efficiency)
•Real-time vehicle data reading via OBD-II adapter (optional)
4.2 Service Warranty
The App is provided "as-is." In particular, we make no warranty regarding:
•Accuracy of range estimates: estimates are calculated based on WLTP data and general driving conditions; weather, driving style, and road conditions may significantly affect actual range.
•Charging station availability: station data is sourced from third-party providers (OpenChargeMap, ZES, Eşarj, Voltrun, etc.); real-time availability is not guaranteed.
•Uninterrupted service: the service may be temporarily suspended due to maintenance or technical issues.
4.3 Safe Driving Responsibility
RouteUp is a navigation aid; responsibility for driver safety rests entirely with you. Do not use the App in a way that distracts you while driving. Plan your route before your trip and use hands-free mode whenever possible.

Pricing and Subscription
5.1 Free Plan
The App's core features are offered free of charge. Some feature limitations may apply on the free plan.
5.2 Premium Subscription
RouteUp Premium subscription may be offered with the following options:
•Monthly or annual auto-renewing subscription
•One-time lifetime license (specific to the Turkish market)
Prices are displayed in the applicable currency in the app store (App Store). Subscription cancellations must be made before the current period ends; otherwise, a charge will be applied for the next period.
5.3 Cancellation and Refunds
Subscription cancellations and refund requests are subject to the policies of the app store where the purchase was made. If you experience any technical issue, you can contact us directly.

Intellectual Property
All content, design, graphics, algorithms, trademarks, and trade names belonging to the App are the property of RouteUp and are protected under applicable intellectual property law. These Terms do not grant you any ownership rights.
The App uses the following open-source and third-party services:
•OpenStreetMap data — © OpenStreetMap contributors (ODbL license)
•OSRM — BSD 2-Clause license
•OpenChargeMap — Creative Commons license
•Firebase — Google LLC Terms of Service
•React Native — MIT license

User Content
If you share feedback, reviews, or content through the App, you are deemed to guarantee that such content is accurate and not misleading. We reserve the right to use feedback you submit to us, anonymized and in aggregate, to improve our services.

Limitation of Liability
To the maximum extent permitted by applicable law, RouteUp is not liable for damages arising from:
•Insufficient charge on trips undertaken relying on range estimates
•A charging station being busy, out of order, or closed
•Route errors or third-party issues such as road closures
•Service interruption or data loss
•Indirect, special, or punitive damages arising from use of the App
Our total liability is limited to the subscription fees you paid, if any, within the preceding 12 months.

Third-Party Services
The App integrates with third-party services such as Google Maps, charging network operators, and similar providers. These services are subject to their own terms of use and may change. We are not responsible for disruptions arising from third-party service outages.

Privacy
Our practices regarding the processing of your personal data are described in detail in the RouteUp Privacy Policy. By accepting these Terms, you are also deemed to accept our Privacy Policy.

Account Suspension and Termination
11.1 Termination by Us
We may suspend or permanently close your account without prior notice in the following cases:
•Violation of these Terms
•Providing false or misleading information
•Activities that harm our services
•Legal requirement
11.2 Termination by the User
You may delete your account at any time via the app settings or by contacting us. After deletion, your data will be permanently removed within the periods specified in our Privacy Policy.

Changes
We may update these Terms from time to time. We will notify you at least 14 days in advance of material changes via an in-app notification or email. Continuing to use the App after the effective date of a change means you accept the new Terms.

Governing Law and Dispute Resolution
These Terms are governed by Turkish law. Disputes between the parties will first be sought to be resolved through negotiation. The Kocaeli (Gebze) Courts and Enforcement Offices have jurisdiction over the resolution of disputes.
The User's rights under Law No. 6502 on the Protection of Consumers are reserved.

Force Majeure
We bear no liability under these Terms for our inability to provide services due to natural disaster, epidemic, cyberattack, internet infrastructure outage, legal regulation, or other events beyond our control.

Severability
If any provision of these Terms is held invalid or unenforceable, that provision will be replaced with the closest valid provision; the remainder of the Terms will remain in full force and effect.
